Housing Rights – A Quick List of the Most Important Housing Rights
A tenant in any state is always entitled to a certain set of housing rights. These housing rights may slightly differ from state to state although they are all based on similar principles. Below, one will find a quick list of the most important housing rights that are available to a tenant in any state in the U.S.
Right to live in a habitable apartment – housing rights – The most important housing rights for a tenant is one that will allow them to live in a habitable condition at all times. The landlord will have to provide a rental property that is sanitary and safe. It will need to have running water, heat, good working locks, smoke detectors and even fire extinguishers in some cases. Housing rights will allow a tenant to break a lease and not pay rent if the rental property is not in a habitable condition and if the landlord has not taken any steps to make it habitable.
Rights to privacy – housing rights – Another basic set of housing rights relate to privacy. The tenant can demand that the rental property be free of neighboring noise, odors and other distractions that will not allow the tenant to experience what is called “quiet enjoyment” of the rental property. Housing rights will also protect the tenant against intrusion of privacy by the landlord. Under most tenancy laws, the landlord will be required to provide due notice of entry before they enter an apartment unless they have to enter for emergency reasons such as fire or floods.
Rights to a legal eviction process – housing rights- Even if a tenant is not able to make rent payments on time; they are entitled to go through a legal eviction hearing in court. Housing rights will allow tenants to sue their landlords if the landlord tries to evict the tenant on their own personal agenda. Some landlords do not bother with a time consuming eviction case in court and will simply lock out their tenants. This is against the law and housing rights will protect the tenant against such acts of retaliation.
Rights to receive due notice before termination of a lease – housing rights – If a lease is expiring and if the landlord does not wish to renew the lease, he or she will have to provide a written notice to the tenant informing them of their decision to not renew the contract. Tenants must also remember that it is also their responsibility to inform landlords of their intention to leave with proper notice if they do not wish to renew a rental contract.
Rights to receive security deposit refunds – housing rights – Though most states will allow the landlord to collect a legal security deposit, housing rights will allow the tenants to receive a refund of these security deposits when they vacate the premises of a rental property. The deposit will usually have to be refunded within a fortnight although some states will allow up to 45 days for the landlord to refund the security deposit.
